These Terms and Conditions set out the general terms of sale in our online shop available at julianessa.com, run by PHU Mateusz Maruniak, Pogodna 16, 60-275 Poznań, Poland, tax ID (NIP): PL9721250453, REGON: 302783563. The business is registered in the Polish Central Register and Information on Business Activity (CEIDG), kept by the Polish minister responsible for the economy.

1. Scope

These Terms and Conditions apply to all orders placed by Consumers and Business Customers through our online shop.

A Consumer, in accordance with Article 221 of the Polish Civil Code, is a natural person who enters into a legal transaction with a business that is not directly related to their business or professional activity.

A Business Customer, in accordance with Article 431 of the Polish Civil Code, is a natural person, a legal person or an organisational unit without legal personality to which the law grants legal capacity, conducting business or professional activity in its own name.

Other or supplementary terms and general terms of trade used by Business Customers do not apply. They become part of the contract only if we expressly agree to them in writing.

2. Conclusion of the contract

The contract of sale is concluded with PHU Mateusz Maruniak.

The presentation of products in our online shop constitutes an offer to conclude a contract of sale. To conclude the contract, add the products you want to the basket and place an order. You can change the contents of your basket and the data entered in the forms before placing the order, using the features and messages shown during the ordering process.

By clicking the button that confirms and finalises the order on the order summary page, you place a binding order for the products in your basket. The contract of sale is concluded as soon as your order is received and registered in our online shop’s system. After placing your order, you will receive an email from us confirming the order and the conclusion of the contract.

3. Language and storage of the contract

The contract of sale can be concluded in English or Polish.

We store the content of the contract and send you the order details and these Terms and Conditions by email. You can also check the details of your orders in your customer account. These Terms and Conditions are also available on our website in a way that allows you to obtain, reproduce and store them.

4. Delivery

The delivery cost depends on the delivery country and the delivery method you choose. The final delivery cost is shown in your basket before you place your order. Current information is available on the Shipping page. Products are delivered by the courier and postal companies we work with. Details are provided during the ordering process and on the information pages of our shop.

Orders can also be collected in person at: Julia Nessa, Pogodna 16, 60-275 Poznań, Poland, from 9:00 to 17:00 (CET).

5. Payment

Prices in our shop are gross prices including VAT, shown in the currency selected in the shop (EUR or USD). The following payment methods are available:

  • PayPal, including payment by debit or credit card through PayPal,
  • bank transfer in EUR or USD to our shop’s bank account. If you choose this method, we will send you our bank details by email after you place your order. We start processing your order once the full amount due has been credited to our account.

Details of the available payment methods, including the integrated online payment services and any additional costs, are shown during the ordering process and on the Payment methods page.

6. Right of withdrawal

Consumers have a statutory right to withdraw from the contract, as described in the information on the right of withdrawal.

The right of withdrawal also applies to natural persons who conclude a contract directly related to their business activity, where the contract shows that it is not of a professional nature for them, in particular in view of the subject of their business activity as shown in the Polish Central Register and Information on Business Activity (CEIDG). Other Business Customers do not have the right of withdrawal.

Cosmetic products. Gel polishes, bases, top coats, gels, acrygels, nail prep products, cuticle oils, creams, lotions, mists and other cosmetics are delivered in sealed packaging. For health protection and hygiene reasons, they can only be returned if they are new and unopened. If the packaging has been opened after delivery, the right of withdrawal does not apply to that product (Article 16(e) of Directive 2011/83/EU; Article 38(1)(5) of the Polish Consumer Rights Act of 30 May 2014).

Other products (e.g. tools, e-file bits, brushes, accessories, devices) should be returned complete, in their original packaging and without signs of use. If a product has been used beyond what is necessary to establish its nature, characteristics and functioning, the reimbursement may be reduced by the value the product has lost (Article 14(2) of Directive 2011/83/EU; Article 34(4) of the Polish Consumer Rights Act).

7. Damage in transit

For Consumers: in a consumer distance purchase, our shop always bears the risk of accidental damage to or loss of the goods in transit. If the products you ordered arrive with obvious damage caused in transit, please report it to the courier as soon as possible and contact us. A delay in reporting such damage or contacting us has no consequences for your statutory rights (described below under complaints). Reporting it quickly, however, helps us pursue our claims against the carrier or transport insurer.

8. Complaints: conformity of goods with the contract

For Consumers: we are obliged to deliver goods that conform with the contract. If the goods do not conform with the contract, the Consumer has the rights set out in Chapter 5a of the Polish Consumer Rights Act. On the terms set out there, the Consumer may request repair or replacement of non-conforming goods, or declare a price reduction or withdraw from the contract. We are liable for any lack of conformity that becomes apparent within 2 years of delivery, unless we have specified a longer shelf life for the goods – in that case, the longer period applies.

In the event of non-conformity, the above provisions concerning Consumers also apply to a natural person concluding a contract directly related to their business activity, where the contract shows that it is not of a professional nature for that person, in particular in view of the subject of their business activity as shown in the Polish Central Register and Information on Business Activity (CEIDG).

Complaints can be submitted:

  • by email to: kontakt@sklep.julianessa.pl,
  • in writing to: PHU Mateusz Maruniak, Pogodna 16, 60-275 Poznań, Poland,
  • by phone: +48 515 238 216.

Information about any additional commercial guarantee and its terms is always included with the product and available on the information pages of our online shop.

For Business Customers (except natural persons concluding a contract directly related to their business activity where the contract is not of a professional nature for them – so-called “quasi-consumers”, i.e. sole traders who benefit from certain consumer rights): in a contract of sale concluded with a Business Customer, our liability under the statutory warranty for defects is excluded pursuant to Article 558 § 1 of the Polish Civil Code.

Information for consumers
When you buy goods, the minimum period during which the seller must ensure their conformity with the contract is at least two years. For your rights regarding the conformity of goods with the contract, please also read the harmonised notice (information template) drawn up in accordance with Commission Implementing Regulation (EU) 2025/1960.

Our customer service is available Monday to Friday, 9:00–17:00 (CET).

9. Electronic services

To use our online shop, including browsing products and placing orders, you need a device with an internet browser, internet access and an email account. We recommend enabling JavaScript and cookies in your browser settings. Users must use the online shop in accordance with the law and good practice. Providing unlawful content is prohibited.

We take all necessary measures to ensure that our online shop’s website and interface work correctly, to the extent allowed by current technical knowledge, and we undertake to remove any irregularities and technical problems reported by users within a reasonable time. This also applies to newsletter sign-up and the optional customer account, if these services are offered in our shop. You can report any irregularities or interruptions in the operation of our website and services using the contact details given above. When reporting a technical issue, please describe the type of problem and the date it occurred.

10. Code of good practice

We have voluntarily committed to the “Trusted Shops Quality Criteria”, available at this link.

11. Out-of-court dispute resolution

Consumers may use out-of-court methods of handling complaints and pursuing claims. Information on access to these procedures is available at www.uokik.gov.pl under “Amicable resolution of consumer disputes” (Polubowne rozwiązywanie sporów konsumenckich). Consumers living in another EU country can also get free help from the European Consumer Centre in their country (ECC-Net).

Using these out-of-court methods is voluntary and possible only if both parties to the dispute (the Consumer and the seller) agree to it.

12. Final provisions

None of the provisions of these Terms and Conditions is intended to infringe the statutory rights of Consumers. If any provision of these Terms and Conditions conflicts with Consumers’ rights under generally applicable law, the statutory provisions will always apply in place of the provisions in question.

Contracts with Consumers are governed by Polish law. If you are a Consumer with your habitual residence in another country, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country where you live.

For Business Customers, all contracts concluded with us are governed by Polish law, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For Business Customers, legal persons under public law and separate public-law entities, the court with exclusive jurisdiction over all disputes arising from contractual relations between us is the court competent for our registered office. The preceding sentence does not apply to natural persons concluding a contract directly related to their business activity where the contract shows that it is not of a professional nature for them, in particular in view of the subject of their business activity as shown in the Polish Central Register and Information on Business Activity (CEIDG).
